"Show Dog/Bitch" has been sold to Buyer by Seller as "Breed/show prospect". Breed/show prospect shall be understood to mean that no disqualifying cosmetic faults as defined in the Siberian Husky standard are evident at time of sale and further that no genetic disorders are immediately apparent.
GENERAL:
Seller shall not be held responsible for the development of non-genetically derived disqualifying faults, diseases, or disorders which are due to Buyer's negligence.
In the event that Show Dog/Bitch is co-owned, Buyer has sole responsibility. Seller retains the right to one (1) breeding to show/bitch with stud of choice.
Seller agrees that show dog/bitch will be bred only to dog/bitch of same quality.
Show Dog/Bitch will only be fed top quality food and fresh water is available at all times to him/her. Show Dog/Bitch will always have safe, comfortable and adequate shelter. The primary residence of the purchaser is as well the primary residence of Show Dog/Bitch.
Show Dog/Bitch's vaccinations will be kept current and he/she will receive heartworm preventatives.
Seller retains the right to get show puppy back at any time should buyer decide not to keep said puppy. This is not negotiable.
If this Show Dog/Bitch is sold, this contract becomes null and void. Apache Run must be notified as to where the Show Dog/Bitch goes. (this is for record keeping as well as assuring that all pups are in happy healthy homes)
Should Show Dog/Bitch develop any disqualifying faults as defined in the Siberian Husky Standard, or be diagnosed with any genetically derived medical disorder which is attested to by two unassociated veterinarians, thereby causing Buyer and Seller to agree that Show Dog/Bitch cannot ethically be bred, Seller will, upon provision of veterinary reports and, where applicable, Orthopedic Foundation for Animals (OFA) report, or Canine Eye Registration Foundation (CERF) certification replace show dog/bitch with one of equal quality, if no replacement puppy is available, new terms will be determined at that point.
If said show dog/bitch is bred Apache Run is under no obligation to replace said show dog/bitch or refund any money thereafter.
Should Buyer choose to keep Show Dog/Bitch, the Show Dog/Bitch must be spayed or neutered before receiving the replacement of a breed quality puppy, and spay/neuter certificate must be provided to Apache Run by Buyer's veterinarian of choice.
Buyer must pay any shipping or miscellaneous charges associated with transport of replacement puppy. All shipping costs for dogs replaced for any reason will be the responsibility of the Buyer.
If, by the time the Show Dog/Bitch is 24 months old it does not appear to be of show/breeding quality, the seller will, upon receipt of a veterinarian's certificate of sterilization, provide a replacement puppy of show/breeding quality when one is available, if one is not available new terms will then be discussed between breeder, and purchaser. The determination of quality is to be made by the seller or by a person or persons appointed by the seller. This determination may be based in part on the dog's show record.
No other guarantee is given except in the case of a hereditary or congenital defect which develops to the extent it renders the dog unsuitable as a pet. In this instance a replacement will be given when one becomes available.
The Buyer agrees to show this puppy for conformation and, if possible, to the completion of its AKC championship, at the expense of the Buyer.
CARE AND CONDITION:
The Buyer has the sole responsibility for properly feeding and developing the functioning Show Dog/Bitch. To the best of his/her ability, the Buyer will provide for a safe and healthy environment. He/She will never knowingly nor through neglect, place the Show Dog/Bitch in harm's way. The Buyer will also, to the best of his/her ability, keep the Show Dog/Bitch in proper health and condition for show ring competition. The buyer will provide a fenced yard to prevent the Show Dog/Bitch from running the streets. The Buyer will provide the care of a qualified veterinarian in the case of illness or injury, and for preventative health care. The buyer will provide proper nutrition as advised by the Breeder or the veterinarian. The Buyer will provide shelter from the weather, both in winter and in summer. The Buyer will at NO TIME allow the Show Dog/Bitch to ride outside of a travel crate, while in or on the bed of a pick up truck or other open vehicle. Said Show Dog/Bitch will not be chained or tethered.
HEALTH GUARANTEE:
Seller guarantees that Show Dog/Bitch is in good health and has received appropriate medical inoculations and care including Heartworm and parasite worming. Seller will provide Buyer with a medical chart detailing treatment Show Dog/Bitch has received under Seller's care, and future care Seller feels is essential to Show Dog/Bitch's well being.
Seller guarantees that Show Dog/Bitch is free of life threatening diseases or disabilities (i.e., heart murmurs, etc.) for 72 hours after delivery to Buyer. Should life threatening diseases or disabilities be discovered by Buyer within 72 hours after receipt of Show Dog/Bitch, and attested to in writing to Seller by Buyer's veterinarian, Seller will provide Buyer with a replacement breed quality puppy as soon as such a puppy is available to Seller, or refund 100% of purchase price. Seller strongly recommendsthat Buyer have Show Dog/Bitch examined by a licensed veterinarian of Buyer's choice within 72 hours of receipt of Puppy.
TEMPERAMENT:
Seller strongly recommends that Buyer attend obedience classes with Show Dog/Bitch and provide proper socialization opportunities for Show Dog/Bitch.
Seller shall not be held responsible for acts of Show Dog/Bitch which are due to Buyers negligence. Should Show Dog/Bitch exhibit anti social behavior which Buyer deems intolerable and irreversible within 12 months after purchase, Buyer will provide Seller with proof that Show Dog/Bitch has been sufficiently socialized and that obedience classes and other structured training methods have been attempted with no results. Upon receipt of such proof, evaluations of Show Dog/Bitch will be scheduled with three recognized Siberian Husky breeders or trainers, one to be chosen by Buyer, one to be chosen by Seller, and one to be chosen jointly. Should Show Dog/Bitch be deemed to have an incorrect temperament by two of the chosen breeders/trainers, Seller will arrange for euthanasia of Show Dog/Bitch and provide Buyer with a replacement Show Dog/Bitch as soon as such a puppy is available to Seller.

If this dog exhibits any or all of the above defects mentioned, a replacement dog will be given to the purchaser in exchange for said dog’s registration papers and certification that said dog has been neutered or destroyed. If said dog is to be destroyed, guarantee is valid only if the seller gives prior approval. Seller will replace puppy within one year with an equal quality or better puppy of the same color and sex.
I hereby understand and agree to all the terms and conditions set forth in this contract. I understand this contract is enforceable under current American Kennel Club rules regarding Contracts and Registration Matters. I understand that failure to comply with this contract as written will result in permanent loss of the right to have the dog registered in my/our name(s). .If either party is forced to take legal action to enforce any part of this contract, action shall be in the county of the Breeder's residence.
Any legal fees and court cost shall be the responsibility of the party found to be at fault.
